Q&A Case pending with USCIS, how to follow up after a request for documents has been answered.


Q- I filed my immigrant visa petition, the case was interviewed. At the interview the officer asked me for a new medical exam, because the physician failed to check a required box on the medical exam. I re-did the medical exam, and mailed the new sealed envelope to the USCIS at the address provided. The case has now been pending over 30 days, what can I do?


A- The USCIS is generally very prompt about responding to applications, where it receives a response to the RFE (Request for Evidence). However, sometimes there is a delay. In order to follow up on the status of the case, it is best to first follow up with the Check your Case status Online link at https://egov.uscis.gov/casestatus/landing.do. If the response on this site is not satisfactory, then depending on the response, you could submit a case inquiry to USCIS at https://egov.uscis.gov/e-Request/Intro.do and if once again this response is not satisfactory, then you may either call the customer service number for USCIS 1-800-375-5283 or make an appointment for an infopass at your local USCIS office and inquire in person. Appointments are made by following this link https://my.uscis.gov/appointment


This process of checking the status of a case is true for all applications pending with USCIS. Once USCIS has received your application, it will always issue a receipt on form I-797C (Notice of Action). That form will indicate the Receipt number of the case, the date it was received, the location of the file, your name, and the Notice type. This information plus your address and date of birth is necessary in order to check the status of the file with USCIS.


Our office recommends that you take each step in order to follow up on a case. In order for our office to obtain a resolution, we would request that you maintain as part of your records the confirmation numbers of all calls made to USCIS customer service, as well as proof of infopass appointment.
